Legal Question in Family Law in Wisconsin

Exercising Father's Rights

I recently lost my job of 10 years and was awarded the right to go to school (free of charge) and extended unemployment pay. I have 2 children and the older one has moved in. Now my ex-wife is suing me for more child support - when I should be getting it from her. I want to know how I can successfully counter-sue for custody of 1 child and child support. It IS in the ''best interest of both children'' to accomplish this.

Re: Exercising Father's Rights

You may file your own motion seeking physical placement. There is a presumption under Wisconsin law that the parenting time with each parent should be maximized.

Your request for child support may be weaker. You voluntarily left employment to pursue education. A court may determeine that this choice should not result in an award of child support.
