Legal Question in Family Law in Wisconsin

Want sole custody

My child was born and I was not married to the father and we are not together, he did not see him for the first 8 months and since then he has seen him about 10 times only at my home. He is not on the birth certificate, he lives in Milwaukee I live in Green Bay, he has given me about $600 total (my son is 16 months) and I have had full custoday and full financial responsiblity. He now tells me he is going to fight me for full custody of my son. I would like sole custody because I have concerns about his ability to parent, financially and emotionally. I have a home in suburb, a great job, relatives nearby, a great in home daycare. What are my chances of winning sole custody and what would I have to prove to win? What steps should I take now?

Re: Want sole custody

Hello,

Has he legally been found to be the father? It seems you are sure that he is the father, so his paternity could be established, if it has not so far. Custody is decision making: where the child lives, goes to school, gets health care, and religion. That is nearly always joint -- they want parents to work together if possible. Placement is where the child lives and who visits. That is where the contest comes in. Based on what you have told me, you should have a good chance to have primary placement, with the father visiting when you either agree upon, or when the court sets a schedule for you. The next step? You should set an appointment with a lawyer for a one hour consultation. That won't cost a lot, and will be well worth the time and money. It will answer your questions in a more understandable way than on email. Also, you will get direction on what other steps could be taken next. I have a law office in Green Bay on Larsen Road near the Arboretum. An initial consultation would be only $50. I can't put my phone number on this reply, but I can if you email me at [email protected]

Best wishes,
