Legal Question in Immigration Law in Wisconsin

husband deported

My husband was deported. He wants to come back illegally but I don't want him to. I'm wondering how long getting him a visa would take since he's already been deported once? He told me the judge said he could come back but I need to know how long it will take so he doesn't decide to come back and get in trouble again.

Re: husband deported

A lot of factors must be taken into consideration: how long did he remain illegally in the United States? When was he ordered removed? Would you be applying for a visa petition for him? If you are, it would seem that you would have to also apply for a permission for him to re-enter the United States after deportation based on extreme hardship the separation would cause you. These waivers are discretionary and could take more than a year to adjudicate. Do not hesitate to contact me should you want to discuss this matter further.
