Will my husbnad be deported?

My husband has illegal status in the United States. When our daughter was born, he was convicted with a Class A misdemeanor, and 1 year probation (no jail time), after 1 year his record was expunged. If he files for residency, wil he be deported?

This is a complicated question, and you should definitely consult with an immigration attorney about your husband's case. There are certain convictions, even if misdemeanors under state law, that can have a negative impact on one's immigration status. An experienced immigration attorney should be able to tell you whether your husband will have a problem applying for permanent residency. It will depend on when the conviction occurred, what it was for, etc.

Even if he did not have any jail time, it is possible that the Department of Homeland Security may begin removal proceedings against him.
