Legal Question in Personal Injury in Wisconsin

Can a lawyer charge cost and fees on top of say his 33-1/3 %? I am being charger $12000. in cost and fees. Plus his 33-1/3% of the final settelment. This was never discussed. I was told his cost would be 33-1/3 % of the final settelment.

Contingent fee arrangements, traditionally used in car accident cases involving personal injuries, normally specify that the client must pay all out of pocket expenses, in addition to the agreed percentage fee on the recovery (which is often 33 and 1/3%). If you read over your agreement carefully, you will probably find language where you authorized these charges. In major litigation, these expenses can run into many thousands of dollars, although in cases settled without suit, they are usually much less (primarily the cost of obtaining medical records and other investigative items), which may even be waived by some lawyers.
