Legal Question in Personal Injury in Wisconsin

I recently hurt myself on a wisconsin sidewalk because of a large crack in it. I "stubbed" my toe on the crack when I didnt see it. My injuries included a broken toe which required surgery, the loss of the toe nail, cuts on the toe, as well as several large scrapes and bruises on my leg. Can I sue the city due to these poorly maintained sidewalk induced injuries?

You have a potential claim if you can show that the city negligently maintained the sidewalk and that the city had notice that the sidewalk needed repair. However, Wisconsin law requires that you serve a notice of injury upon the city within 120 days of date of the injury. The statutes specify exactly how the notice must be served and what the notice must say. Therefore, you should find a lawyer to help you with pursuing your potential claim.

The statutes that apply to your potential claim are Wis. Stat. sec. 893.83 and 893.80.
