Re: workmans comp

Under Wyoming Workers Comp. law, the fact that an employer failed to carry workers comp. does not necessarily mean that you cannot receive workers comp. benefits. (The employer may have to pay all of the benefits out of its pocket, but that is not your problem, especially now that you have been fired.) You still need to file a report of injury with the division immediately. There may be other steps that you should take, depending on the status of your case, date of injury, and whether or not you have received any benefit denial letters from the Division of Workers Comp. You may also need to consider action against your employer, depending on whether you were a contract employee or an at will employee and depending on the terms of your employment and the basis for your termination. The best advice I can give you is to file your report of injury with the Division, make sure your TTD Certifications are in place and current from your physicians, and contact a lawyer for help. If you have been denied benefits, the Division pays your attorneys fees and costs for you.
