Legal Question in Veterans Law in Texas

PTSD from rape while in the Army

Hello, it has been almost 16yrs since being honorably discharged from the Army and I have recieved Counseling for PTSD for at least 12 of those years from both outside counselors and at the VA. I have a 50% disability for a back injury and airthritis caused in the army mostly from Fibromyolgy that developed after I was raped by my one of the Majors. Can I increase my disability rating with my PTSD. chronic, severe. Diagnosis from VA medical center that I recieved last year?

This is quite plausible to have an increase in benefits for such an occurrence as this. You need to seek out one of the service organizations and obtain the services of one of their representatives to file your claim. Most of the organizations have female counselors who can assist you. The DAV and the PVA are two good organizations for this purpose.

You should definitely file for PTSD service connection and the sooner the better. Physical assault cases allow for evidence other than official records to prove your case. You may benefit from an attorney or service officer reviewing your service records to help you prepare items to support your case. Just file asap to get your effective date running. You can then add evidence as the case goes along. Feel free to email me with any further questions.
