Legal Question in Banking Law in India

A Cheque issued by RTO Chennai bounced back on a/c of signature mismatch...this cheque I received after a struggle of 2 years.

Now they are telling you send this cheque back and we will issue you a fresh cheque...I know it is not at all easy to take another cheque from them...It may take even six months or more..

This amount I got as a refund.

kindly guide what to do?

Dear Seema,

What you can do is to take a photocopy of the cheque and obtain an acknowledgement from RTO Chennai on the photocopy while handing over the cheque to them with your covering letter requesting them to issue the fresh cheque at the earliest.

Due mismatch of signature you cannot use Sec. 138 of the N. I. Act. Only option you have is to get it reissued. Obtain a proper acknowledgement - that you have delivered improperly signed cheque back to them, and also seek in the covering letter urgent replacement of the same.
