Dear Sir

The loan was sanctioned by the nationalised by Bank in the Year 1995 and the company become the NPA in the year 1998, the Bank has filed the case in the year 2003, by showing the debt cum acknowledgment signed in the year 2000, but actually it was not signed by the borrower in the year 2000,

The bank has got signed in the Blank Debt Cum Acknowledgment at the time of availing the loan. But it was not signed by the Guarantors.

But the bank has said in their affidivate that it was signed by the borrower and Guarantor.

is it he bank has rite to file a case against the borrower, please advise.

THE original application was filed in DRT chennai in the year 2003, but the proof affidivate was filed in the year 2008, the bank stated that it has lots the original mortgage loan document. is it possible to file a case with out the original title deed deposited by the guarantors.

the case is still pending in the DRT Chennai from 2003 to 2013.

There is no point in raising these issues here. Fight out the case pending in the DRT effectively thru your Advocate.
