Legal Question in Banking Law in

I have taken personal loan in a bank for a period of 48 months and i have repaid 22 months. I have not able to pay the emi from january 2010 since i have lost my funds in a finanical company, but i am willing to settle personal loan and bank employees told me that they will raise a request and will inform me, but in the mean time the cheque was presented in the bank it got bounced, and they have produced me summon to present in the court.

1. whether i need to present in the court.

2. Still i am ready to settle bank, but they are asking me to pay 1,15,000 but i am willing to pay 80,000. is this will be acceptable in the court.

Please can anyone help in this regard

Engage a good lawyer and through him persuade the Bank management for a one time settlement.

Immediately contact a Lawyer and side by side contact Bank's higher officers and make a request for the One Time Settlement with the Bank and offer them maximum you can pay, and try to settle your accounts.

If the Bank agrees to your offer then keep it in mind and dont forget I repeat dont forget taking a clearance certificate and no liability certificate stating therein that now there remains no Liability upon you of the bank and also that the case (if any registered against you) to be withdrawn.
