Legal Question in Business Law in Nigeria

I lead an organization which is not registered with CAC yet and we have strong social impact concerns. Within the next 8 years we project to be operating full capacity. That means we would have been registered with CAC and will not necessarily need public fund to run the NGO arm. but there is an opportunity to make a real impact now as per our NGO concerns, and there are no organisations who are willing to or even capable of handling these concerns, that we may partner with. So we want to start our community service projects, that is our NGO arm to make good, of the opportunity for impact.

My question is, as per organization structure, is it possible to register and run the NGO before We are registered as an organization under CAC?

It is possible to run the NGO before proper registration with CAC. I however would not advice you to do it that way because of the following;

First, you may have a problem in future where you have started getting known by an unregistered name and when you finally decide to register with CAC the name will be unavailable thus causing problems. Second you will not be able to have a corporate existence without registration.i.e. Having bank accounts, corporate seals, trustees etc. Third you will not be able to enjoy the benefits the law confers upon you when you register. Fourth most organizations do not like to deal with unregistered associations.
