we are 2 brother and 1 elder sister , i am staying in a house which belongs to my late mother .my elder brother and sister not staying with me . i am staying with my son and daugther in law . my elder brother have sent a partition notice for this house and he also wants to enter into house which i have resisted.so he is doing nuisance outside my house premises. i dont want him to enter in this house .so can i do that ? i am staying in this house since 2005 and that time only he shifted to his new house .i am paying all maintenance charges ...kindly guide me what shall i do to get possession of this house?

Dear Sir,

If your deceased mother has left behind her Will naming you as the beneficiary of the house, you should Probate her Will through the Court and get the title of the house transferred in your name. At the same time, you should negotiate a reasonable financial settlement with your elder sister and brother so as to be fair to your brother and sister, for parting their share to you, in the property.
