builder/seller was sold a floor to user/purchaser with the conditions of builder/seller shall be start construction on said property after free hold and approval of mcd and builder/seller full fill this both conditions and demand for and now he start the construction and builder/seller demand his part payment as payment schedule settled between both party i-e part payment of bhumi pujan and other but user/purchaser denie for pay to part payment to builder/seller . Now the question is it possible that the as per clause of agreement to sell " If the purchaser back out from his commitments or conditions not follow the terms and conditions then builder/seller shall be for fitted earnest money " Builder have to right of for fitted that earnest money and sold to another person or not?
