Legal Question in Civil Rights Law in India

I want to challange a mutual partition deed in Court which is illegal and void due to not mentioning the name of the sisters of the deed executors. One of the executor bought a part of the land of the mutual partition deed from an another Executor of the mutual partition deed in due course , stated herein above and take a Bank Loan for Housing thereon in the name of his son . My question is ,"Can I ( being a legal heir of one of the executors of the mutual partition deed) lodge a complain against my cousin to the Bank Authority , mentioning the illegal , void deed along with the copy of Title Suit and requesting them to take the proper action immediately ? Is there any scope in the hand of my cousin to file a deframation suit for my complain to Bank ?

You need to answer few questions - once you answer them - more may be there.

1. Have you filed the suit?

2. If yes, have you taken injunction?

3. When the partition took place?

One needs answer to above before answering your query.
