Legal Question in Civil Rights Law in India

I'm living in gurgaon village, lal dora land, my uncle is also living in 1st floor in single room, he does not allow us to reconstruction our house, it's not in good condition. In MCD it's showing at my father's name who is not alive and electricity meter is on my mom name, we are paying house tax received on my mom name. please advise us how can we get rid of our uncle because he is not ready in how any how?
