what is process of change old advocate from the case and appoint new advocate legaaly if the old advocate taken full and final paymnet from us without reciept and new advocate could not give us reciept against the next fees of that case>

Dear Sir / Madam,

Each and every Advocate / Lawyer / Solicitor is legally bound to issue a stamped receipt for fees collected by him / her from each and every client. You can file a written complaint against the practitioner in the Bar Council of India in the event he / she fails to issue stamped receipts for payments accepted. You should insist on receipts with details of nature of payment like representation fees etc. clearly mentioned on the stamped receipt. Your application for change of Advocate has to be filed with the concerned Writer and Court Clerk.

You should insist for a fee receipt from the old Advocate as also from the new Advocate. If they refuse, you may file a complaint with the Bar Council of concerned State.

you may seek NOC from the earlier counsel and seek receipt from the new counsel. no ground made out for approaching bar council.
