Legal Question in Civil Rights Law in
I am a shareholder of the Registered CHS Ltd, In Mumbai. The CHS buildings were completed in Apr,1968 after the BMC approved the plans in In Nov.,1965. However these building plans were submitted by the Mortgagee of the land (with the permission of the society) who had entered into the Conveyance Deed with the Society. Apparently the Owner did not concur with this. The Owner of the land still continues to be the holder of the land on the property card. Now , the society plans to go for re-developement without having its name on the Property card and the buildings existence records on the survey maps .
1, How to bring the Society name on to the Property Card and update the survey maps with the true picture ?
2. Can the Society go ahead with the Re-developement before completing step 1.
3. What are the risks associated with this move of the society to its interests and its members if step 1 is not completed ?
4. How can the members challenge the M. Committee, if it decides to go ahead with the redevelopment with out the first step by getting the majority support in the general body without telling the members the risks associated , if step 1 is incomplete ?
Please help clarify the position of the following parties:
1 The Society
2 The Owner of the land who is a mortgagor
3 The Mortgagee of the land
4 The rights of the individual members/shareholders
