Legal Question in Civil Rights Law in India

Hello Sir, I had bought sofa from one of the shop in my home town, it has warranty for 7 years and i hold document for same. last year there was some problem with sofa so I gave it for repair to the shop person, also i had paid him rs 5k as the fabric was not covered in warranty. after i gave my sofa within a month he closed his shop and started saying it would take time as there was sales tax raid on his shop so the work is stopped. further he kept on giving excuses and i haven't received my sofa yet. earlier he use to answer my calls and use to give excuses but now he is not even bothered to answer my call. his shop is closed now. i feel cheated, sir, please let me know what i can do in this case.

thanks for considering.

Dear Avinash,

I guess it must be a sofa made of wrought iron metal to have a 7 years warranty, which is usually for the metal structure and not for the upholstery. Since you paid Rs. 5,000/- (Rupees Five Thousand Only) for replacement of the fabric upholstery, the shopkeeper ought to have replaced the worn out fabric with a new fabric thereon and handed over the sofa back to you. Lodging a Police complaint to trace the Shop Owner to ensure you get your sofa back duly repaired is recommended.

Regards,
