Legal Question in Civil Rights Law in India

Sir,

I am elected as a President to the members association of the society I live in. We have not registered our Association under Societies Regulation Act. This association was established in August 2013 by preparation of Memorandum of Association and selection of President and Secretary by a resolution from majority of present members.

Now the problem we are facing is that 2-3 members of the society are bluntly denying to pay Annual Maintenance Charges as decided upon by the Association in general meeting. As the Association is not registered, in this scenario what legal action can the Association take against such indifferently behaving members.

Your kind guidance into the matter will be highly acknowledged.

Dear Manthan,

Since you do not have any locus standi at present, you need to form and register a Co-operative Housing Society and elect office bearers thereto.
