I own 'www.odesk.company', and I am contacted by 'www.odesk.com' with a trademark issue. What should I do?

no misleading incitement to the customers exist in your case, especially, when customer is a surfer of more than an average intellect... even otherwise, it is yet to determine who initiated first, and who obtained the trade mark or at least made an application first.

Get your own trade mark registered which must not resemble closely to the trade mark of the www.odesk.com
