Legal Question in Construction Law in India

Sir,

I'm a resident of a town named Chanderi. There is a Village Pranpur where my family resides in their parental home. We have some land behind our home since more than 25 years and it's not registered as most of the land is that village is not registered. Entire village knows that that's our land. Now we have started construction on that land which is completely ours but one of our neighbor who has nothing to do with that place has sought stay orders from SDM. Let me give you an overview of this neighbor. He has been our enemy since last 40 years and do not want us to succeed in any way. He has done all the construction by encroaching public place and installed a hand pump in his boundary and then covered it. He has also attacked on our family 2 years ago and a case is already being heard in district court. I would like to mention that my family escaped their death in that attack. Since I'm the only earning member of the family, I have to stay away in Kolkata for my bread and butter. My parents are all alone their and can not fight with them, on the contrary this neighbor frequently visits police station and register false complaints. Since few people get water from his hand pump, they have signed on his stay order appeal but at the same time all signatories told that they can sign on our application also. Few neighbors know that that land is ours and are in favor of construction, they know that this neighbor is crook and do not want us to sustain and grow in life. I request you to give us some idea on how to get away from the stay order and this annoying neighbor. Please help as it has devastated me mentally. Safety of my family is at stake.

Dear Sir / Madam,

It is advisable to get the land registered in your name with the local District Tehsildar so that nobody can object to any further development on the land. For your safety, you should also lodge a Police NC against the neighbour who is constantly harassing and threatening your family.
