Legal Question in Consumer Law in India

I had booked a flat with Bangalore builder. We applied for loan. But the builder made a fuss in giving the documents. Later when everything was done when the loan was sactioned, those guys started asking for late payment as interest.
We stopped the payment and they said they will cancel the booking.
We after went for a mutual settlement ,and agreed upon making new booking. They accepted because money was still their with them. Later we said we would like to involve our lawyer to make some changes, because the agreements were in their favor.
They did not agree for that. So we asked for the money back. He said that he would return money once he sell the flat for the new buyer. But it is 2 years now he has not even completed the project nor he sold the flat. He has fooled many buyers like this.
This is going on since June 2010.
Project was supposed to get completed by this time. BY JUNE 2010
