Legal Question in Consumer Law in India

I visited my four wheeler workshop for ac problem and they diagnosed that the radiator fan is missing. The vehicle is under warranty and only serviced in workshop. I suspect the part is stolen from workshop during last service(2 months back/3000 kms). Workshop arguing that without radiator fan car will not run but the car practically running without it. They are not ready for a free fitment or assist me for theft insurance claim (insurance done through workshop). For denying insurance claim their argument why thief had selectively theft the radiator fan? Now being a self driven vehicle and knowing that the part been removed by workshop only neither I am getting a free part nor getting insurance claim. What should I do?

Dear Sir / Madam,

You cannot turnaround now, suspect and say that the radiator fan could have been stolen at the workshop two months back. A car runs without the radiator fan, but the engine will heat up tremendously at short distances that the car runs. Since the fault is yours, you will have to purchase a new radiator fan and get it fitted in your car, requesting the garage to waive the service charges on the fitment.
