Legal Question in Criminal Law in
30 days post dated cheque alongwith a Proposal letter for one time settlement for the X amount was sent to my cooperative bank.the bank neither approved nor rejected the proposal but has sent the chwque for collection,which has dishonured for insufficient funds.the bank has filed case u/s 138 NI.can there be relief to me under the Bombay high court rulingPDC will not attract) and Supreme court ruling(settlement or compramise cheques,Lalit kumar vs state of Uttar pradesh) to get the case dismiss.
