Legal Question in Criminal Law in India
One gentleman gave me check for 150000rs which bounced for -insuffient fund-he stated in the court that he has no acquintance with me and he had published paper ad stating that he lost the cheque during transit,paper ad given six months earlier than i present the cheque,now they summoned bank manager for ask abt the stop payment,if manager says clerical oversight do i have any hope in this case,stop payment said to be given ten days earlier than paper ad,i have no evidence to prove liability,money given as hand loan,

well if he can establish that the cheque was lost in transit and he stopped the payment the onus shifts on you to prove the liablity and that the cheque was given to you by the accused towards his liablity. If you cant prove it the case will get dismissed.
