Legal Question in Criminal Law in India
Hello,
I filed a forgery case against my brother and others in Hubli for selling fraudulently without my GPA or any authorization my joint family properties in which i am a 1/4th share holder as per my name appearing in all the documents made by my late father. The case was closed by a lower court and I have filed appeal in Higher Court in Hubli.
Now the case (both Criminal revision petition and Partition suit) has been going on in Hubli since 2019 both in Criminal Revision Petition and Partition Suit. I understand that the respondents have not attended the Court Hearings even once since 2019 and many times even the Counsel for respondents are absenting.
Kindly advise if this is permitted that the respondents and also their Counsel absent on Hearings in the court. I have attended many hearing dates on my own initiative.

In case the absence of counsel and party is their, the case may be decided ex parte against them.
