Legal Question in Criminal Law in India

Sir can we filed an application under section 444(3) before session court. Actually my bail application is pending before session court and in that bail application a suritey want to discharge. T he word which is used in section 444(3) is Magistrate, and if we can't this so then what is the procedure of discharge the suritey if bail application is pending before session court.

You can move an application for discharge of surety.

Application may be move before the Court which accepted the surety and bond.
