Legal Question in Education Law in India

Dear sir,

My name is hardik.

I wants to know about the fees refund from the college.

I was join my My MCA in 2010, Paid 1st sem fees (Month August to December ,2010 ),

Also paid 2nd ( Month- January to June, 2011 ) and 3rd sem fees (Month - August to December,2012 ). But after 3rd sem exam I was detain because of unsufficient backlog/ATKT in 1st and 2nd sem.

Gujarat Technology University had declared me as detain student in June 2012. I was not eligible for 4th sem.

I was aware about this thing and not join 4th sem and start doing work from February 2012 to december 2012. During this detain time i was also give my backlog/atkt exams. After that, I was paid my 4th semester fees ( in February,2013 ) with the expectation that i will clear my backlog and continue 4th sem.I was start attending 4th sem. lectures, attend internal exam also. But in the month of June 2013, University had again declare me detain because this time also i was not clear my 1st and 2nd sem backlog.

Now i do not wants to study. I am asking to college for refund my fees of 4th sem because GTU has declare not eligibale for 4th sem. College deny my request. They are not refund my fees.

Please suggest me, can i ask for refund my fees in this case ??

Dear Hardik,

NO. You are not entitled to apply for a refund since of the total duration of 6 months of the IVth semester, you have already attended 5 months (Feb, 2013 till June, 2013). So the college may not agree to giving you any refund of the IVth semester fees, but you may still try to get the refund by writing to the Principal accordingly.

you can demand for completion of you study.

I HAD DONE SAME CASE against MDU Rohtak and students got the relief but not refund.
