On the dishonour of a cheque, one can file a suit for recovery of the cheque amount along with the cost & interest under order XXXVII of Code of Civil Procedure 1908 ( which is a summary procedure and) can also file a Criminal Complaint u/s 138 of Negotiable Instrument Act for punishment to the signatory of the cheque for haring committed an offence.

However, before filing the said complaint a statutory notice is liable to be given to the other party within a period of limitation prescribed. And in case, the person who has drawn the Cheque does not pay back the amount after service of statutory notice, one acquires a right to file a Criminal Complaint directly in the Criminal Court, but within the statutory period of limitation. If you have signed the cheque, then you are liable in the event it is dishonoured. However, the University would first have to send you a statutory notice within a specified time limit before it can proceed with the criminal complaint.

It is advisable that you hire the services of lawyer, because you cannot complete the task and comply with legal technicalities on your own. If you have further questions to ask, you can call me at 09555 507 507 or send me a mail at [email protected]
