Legal Question in Family Law in India

Dear Lawguru,

My advocate has cheated me.He charged from me Rs. 2.5 Lakhs by cheque and Rs. 1.5 Lakh in cash for fighting my daughter's case - three cases in Ghaziabad court and one case in Delhi court. Now, I suspect that he had taken money from the opposite party and now not taking any interest in our cases giving free hand to the opposite party. This Advocate practices in Supreme court and other courts in Delhi. What should I do? Where should I file a complaint against him or what other action can be taken against him. Regards,

Just because you feel that lawyer is not taking interest in your case is not professional misconduct. If he is deliberately not appearing in courts despite repeated adjournments due Ro his non appearance, may amount to same. However, it is advisable to change the lawyer instead of concentrating your energies towards other side. Suspicion is not considered a proof.

dear friend,

Don't divert your energy, just ask him to return your money back and engage any other lawyer.

otherwise any complaint without proof will not give you any fruit and moreover if you failed then he will file case of defamation against you. on the other hand you will also loose your main case.

Take the brief case papers back from him, engage another lawyer, and concentrate on that work.

If you still wish to purse the matter, you may file a complaint, against him with the Bar Counsel, but you shall need more to support other then your suspicion.
