You should file a case for the custody of your son, and also demand for your dower (if dower has not been paid to you yet) and your maintenance.

In my opinion you should file a Habeous petition before Session Judge. on very next day your son ll be handed over to you as he is in very tender age.

After that, custody matter ll be decided on merit Guardian Judge.
