Legal Question in Family Law in Lebanon

Hello! We are Lebanese who got married civilly in Cyprus few years ago and we want to file for devorce. I need more details about Gardianship and the husband's financial responsibilities towards our child.

Dear Madam,

We understand that you have been married civilly to a Lebanese guy in Cyprus, and that you have a child in common.

You are about to divorce, and are seeing and legal opinion in this regard.

Here is our reply.

Firstly you should note that the civil Courts in Lebanon will have jurisdiction to rule over your case.

The solution of your case differs depending on if you have a settlement agreement with your husband or not.

If you have a settlement agreement, it should cover the divorce and all the related issues, as the child custody and alimony, etc. In that case the Civil Court will ratify it and then after you can enforce it.

If you do not reach a settlement with your husband, The Court will have to rule on the following issues:

1- If you have valid reasons to divorce, and if it is so if you are entitled to compensations?

2- Who will have the guardianship (الحراسة) and the custody (الوصاية) on the child?

3- Who will pay his alimony and in which portion?

4- How to divide the common goods between you: bank account, car, common property?

The answer to the above questions will depend from the facts of the case, the financial and moral situation of both parties.
