Under Muslim Inheritance Law, My father has donated a property of a house and hotel to a charity foundation through a HIBA. He died after that. My father a wife, two sons, one daughter, a full sister, a consanguine sister, a predeceased son’s sons, a predeceased son’s daughter and one predeceased daughter’s son. But before dying, he contacted the foundation and wanted to revoke the hiba partially. He wanted to recover the HOUSE from the gift. But the next day he died. As a son, can I file a case on the owner and if I file a case, on what issues should i file? Can i challenge the validity of the gift and the partition?
