Legal Question in Family Law in

for mutual consent divorce can petitioners choose wether to go to family court or to district court? also -- do advocates remain present in the family court or the matter is dealt between judge and petitioners only? which of the two is the better option? is the 6 month period after filing first motion mandatory or can it be relaxed under any circumstances?

if there is family court then dist court's jurisdiction gets ousted. it is not your choice to choose court. Advocates can be appointed by you. depending on circumstances of each case the court may relaxed 6 months period but the discretion is used in rarest of rare cases

a) You need to file the case before District Judge of your area;

b) Presence of lawyers is optional. You may engage your lawyer with a stipulation that he shall remain present during hearings;

c) Six month's condition is mandatory and cannot be waived.
