I require to understand how under Indian Law can i claim for custody of my son who would turn 7 years on 30th Oct-10. He has been staying with his mother at her place since he was thirteen months(13months). I have not proceeded for divorce though but I would like to have my son with me.

As per Indian laws, father is the natural guardian of a child more than 5 years of age. You may claim custody under the H.M.G.Act by filing appropriate petition.
