Sir, I Belong from Ranchi in Jharkahand.

Here is My Case:

On 19th May 2008, I and My Wife on mutual Consent Dissolved our marriage 0f 8 years according to the Muslims Customs. After that we Signed a Divorce agreement on non-judicial stamp paper of 100 rupees on 29th 2009. I was Forced to sign that by my ex-in laws, and they threatened me that if i don't sign the agreement they will file an FIR in the police station and will implicate me in a False Criminal case. In the Agreement they forcefully added a clause which said that I will pay them INR 3,00,000/- within 4 years from the date of agreement. Now,since the 4 year deadline is over they are continually forcing me give the money, and I don't have the money to pay them. What Should I do? Please Help me!!!

In your case, its imperative to know the mode in which you dissolved your marriage. Under Muslim law, in mutual divorce, the wife may forfeit her claim over the maintenance or mehr. What sort of paper wa prepared at that time. Was it Khula or Mubarrat? So, all the terms and conditions were to be laid down at that time alone. Divorce agreement on stamp paper has no meaning under Muslim law. Nothing will happen to you. Let them do whatever they can. Show me the paper only.
