Legal Question in Family Law in India

My Sister is fighting for a Divorce and Domestic Violence case in Lucknow (UP), where-in her Husband who is in UK (London) and has been avoiding court presence. Court has alredy Impouded his passport and now is issuing a Non Bailable Warrant. The court seemingly is not aware how the same will be served to the accused in UK and has asked us the same. We are not sure what is the process to be followed to get the NBW served in UK and through what route.. (MHA, Indian Embassy or Police).. Request your guidance on the same.

For that matter of fact you have to take assistance of Ministry of External Affairs Indian Embassy in UK for getting the Warrant served upon him.

Further when the Passport has been impounded then how come he is still in UK?

Service of summons on an Indian settled abroad should depend upon his immigration status in that country. Besides, he may also be served on his last known address in India.

The court may send the summons to Indian High Commission in UK to arrange 'service' of summons.
