If my wife don't want to leave with me and we have a baby, can I ask for help to the court?

From your question it is my understanding that, you are not in good terms with your wife and you want her to leave you. In such a case you should divorce her in accordance with your religious belief. However the fact remains in relation to custody of your baby.
