Legal Question in Civil Litigation in India

Good morning sir,
I have one step brother. He is residing in our own house consisting 2 portions which was constructed by my dad. The property is registered on my dad's name. My step brother has given my portion for rent. My mother, sister and myself residing in another rented house. Now we want to enter into our own house. But, my brother was not allowing us and not vacating renters.
How can we get an order from the court to vacate the renters?

You can file a suit for partition or seek residence order under domestic violence act.
