Ang ebidensya ay maaring documentary o testimonial. Kung sino ang nakakaita ng mga pangayyari siya ang magiging witness or kung may mga dokumentong na magpapatunay yun ay ebidensiya. Depende kung gano na katagal ito. Hindi mo sinabi kung gaano katagal na kung ito ba ay 20 taon na etc. Ang tawag dun sa lumipas na taon ay presciption na kung saan mo lamang pwedeng ismapa ang kaso.
