Legal Question in Immigration Law in United States

I am a US citizen and I have a finace I have been dating for three years. He came to the United States on a student visa. We are getting married in janary and I am going to be filling for a green card for him. I use to work as a store manager but lost my job four weeks ago. Does not having a job affects the filling process? I worked all through 2015 until I lost my job on November 26th. Would I be required to get a sponsor for him? Thank you.

You must meet the income guidelines (generally 125% of the poverty level based on house hold size - also listed on the immigration forms site at I-864P) by completing and filing an affidavit of support. This would include proof of income (or enough assets) as well as proof of current employment. If you are not employed, you can seek a joint or co sponsor. Depending on the facts, his income may be included. I would suggest you retain an knowledgeable immigration attorney to assist you.
