Legal Question in Employment Law in

I had filed OA in CAT on three issues. The CAT decided against me both on merit and limitation. I then moved to High Court. In the mean time i find that out of three issues i am contesting- 2 are now meaningless and 3rd issue is now backed by a decision of Apex court. Do i withdraw my old writ and file fresh writ only on third issue with judgement of Apex court.

No you should not withdraw the petition. You may file the application before the Hon'ble Court restricting your challange to one claim only on the basis of the decision of the Apex Court. You can do the same at the stage of the final arguments on oral submissions also for the same and request the court to give the decision on one point only and other points of challange can be given up
