Legal Question in Landlord & Tenant Law in India

Hi all,

I am staying in pagdi system building since 1957 in mumbai. we (me , my dad and mom)used to stay with our grandfather and grandmother and till date we are residing in the same house.my grandfather and grandmother died in late 90's.

In the 1st place we used to get rent receipt on name of my grandfather , still till date we are having rent receipt on name of my Grandfather.

my query are

1)we want to have the rent recepit on my dad's name ?

2) Do we have to pay any money to landlord for transfer of name on the Rent receipt ?

3)we want to renovate our house ? do we have to pay any money to our landlord for that ?

4)Our Building is almost 66 years old ? What is the age of building or rule under which it becomes necessary to have it reconstructed ?

Dear Sir / Madam,

1). YES. Your grandfather or grandmother ought to have left behind a Will nominating the transfer of the tenancy rights in the name of your father. In that case, you can write to the landlord submitting a copy of their Death Certificate and the Will, to transfer the rent receipt in your father's name.

2). YES. You will need to negotiate the monthly compensation for the premises with the landlord, and get the receipt for monthly payment in the name of your father.

3). NO. You do not have to pay any money to the landlord for internal renovation of your house.

4). Since your building is more than 50 years old, a structural audit of the building has to be carried out by a certified Civil Engineer every two years to ascertain whether the building has to be reconstructed.
