on what basis a change of user application by a member in a cooperative housing socity in mumbai can be denied?

Dear Sir / Madam,

Section 19(A) of the Maharashtra State Co-operative Societies Act, 1960 specifies conditions for membership of a Society. Clause (iv) reads :

Clause (iv) - the member has given an undertaking in the prescribed form to the effect that he shall use the flat for the purpose for which it was "purchased" by him and;

Section 68 regarding Levy of Charges by the Society specifies duties and obligations of a member to the Society. Clause (xiii) reads :

Clause (xiii) - any other charges approved by the General Body at its meeting.

If the member contravenes or violates Section 19(A)(iv) and / or fails to pay the charges levied by the Society for change of user, the application by the member thereto can be rejected by the Society.
