Legal Question in Landlord & Tenant Law in India

Dear Sir,

We had a house in the name of my mother but she is no more. We had 4 brothers and work outside the country. Therefore we had given the keys to my neighbor to take care for it. When we came back he is not giving keys, However when we told him that we will sell it ,then he told us that if you do it then he will make fake papers for the house and prove that it is rented for us for several years and file a case in the court and in that case you will not be able to sell it. Sir since we all 4 brothers work outside the country we cannot fight case in the court. Therefore can you please guide us what to do? Is there any cell for NRI so that we can get us our house back. Please respond as we all in a big trouble.

Dear Sirs,

The very first thing you should do if the neighbour is acting adamant to give back the keys of your house is to lodge a Police Non Cognizable (NC) complaint. After you take the custody of your house, the next thing you should do is to immediately trace all the documents and papers in the house, that are left behind by your mother to ascertain her final wish on her property and all other family belongings. Do these two things first and then proceed.
