Legal Question in Landlord & Tenant Law in India

Hii... My husband expired in 1996... After that my father has taken me after selling all my land of my husband and taken that money himself... He also expired on 2002 and he has not written anything on my name and also my brother dont want to give me anything and want me to leave the house in which I am living.... This house was made by my father and was on his name but my brother has transferred this house in his name.... My mother is still alive and lives with my brother.... Iam living on this house since 1996.... How can I ask for my sharing? What can be done?

you have to claim your share of husband's land. and also file a suit for partition to claim your share in father in law properties. Brother in law cannot throw you out. You may file for protection for Right of Residence under Protection of Women from Domestic Violence Act . Being a woman, you are entitled to free legal aid from your state Legal Aid Authority who have offices in district court.

Dear Madam,

Your brother cannot compel or force you to leave your maternal house. You can also challenge the basis on which your brother has got the house transferred in his name after the demise of your father, since you too have a legal right and share in your maternal property.
