Hi I have query regarding my ancestor property, the property is in my father name and his two brothers, in this the entrance gate is common and the gate open in my father portion, there is possibility to give passage of three feet which is standard as per my knowledge the problem is in our portion there were two shops, one is occupied forcibly by my cousin and he is not ready to vacant,n i want to sell my portion

please suggest what i may do to proceed further

dear client...

you can give legal notice to ur cousion and ask him to vacate the shop and then file EVTS case... once case is filed he can not sell the shop... for any query mail me at [email protected]

Dear Sir / Madam,

You should first partition the property between your father and his two brothers so that your portion is clearly identified and in your father's name. If your cousin refuses to vacate the shop, you can lodge a Police complaint against your cousin for illegal trespassing and simultaneously pursue eviction proceedings against him to enable you to sell your father's portion of the property.
