Transfer of the office.

Dear Sir,

My father purchased a 50 Square feet area office in Mumbai, which is

a pagdi building it is not a commercial property

but a residential area which has been converted in a office with a loft. My father expired in

1997. My mother lives in our native place and my brother lives in mumbai. The rent receipt

still comes in my fathers name. since i was handling his business and still am, the mother

has given her right to me and has instructed me to give my brother a sum of Rs, 70,000 as

his share according to the value which was decided in the year 1999. out of which 25,000

was paid at that time in cash. The balance of Rs.45000 is mentioned in the will made at.

that time. I want to know how to get the property transferred in my name now. My mother is

alive and has no problem in transferring the property in my name but wants me to get it

transferred after her death because of emotional attachment to the property. Kindly help me

Dear Anil,

Your first task should be to get the landlord to issue the rent receipt in your mother's name. Thereafter, once that is completed, you should tell your mother that you are willing to pay off the remaining Rs. 45,000/- to your brother requesting your mother to register a Will to the effect that the tenancy rights standing in her name should be transferred to your name after her.
