Legal Question in Legal Ethics in India

The employee while in employment got recorded his son's date of birth as 1.4.84. the employee dies. upon death of the employee the said son for compassionate appointment submits matriculation's certificate. in the said matriculation certificate date of birth of the said son is recoded as '1.4.90'. thus the date of birth i.e. '1.4.90' appearing in the matriculation certificate is later to date of birth i.e. '1.4.84' got recorded by the employee in his serivce records. if, the matriculation certificate is relied upon the said son did not take birth on the date i.e. '1.4.84'. the employee must not have declared the date of birth i.e.'1.4.84' 'in presumption that the said son will take birth on 1.4.90. it is a clear case of wrong entry of date of birth in the matriculation certificate. how to deal with such cases.

Dear Sir / Madam,

The deceased father has rightly submitted the Date of Birth of his son as 01.04.1984 along with proof as appearing on the Birth Certificate which is the original, authentic and applicable evidence for consideration of compensatory and compassionate job, which the concerned Department is considering to grant to the son. In my opinion, the date of birth 01.04.1990 appearing in the matriculation Certificate is incorrect, and should be overlooked and ignored.
